We gather nonpublic information about our customers as may
be necessary to conduct business with our customers.
We collect nonpublic information about you from the following
sources: |
- Information you provide to Downey Savings on applications
or other forms, over the telephone or in face-to-face
meetings and via the Internet. Examples include your
name, address, telephone number, e-mail address, social
security number, credit history and other financial
information;
- Information we obtain about your transactions with
us, our affiliates or others. Examples include payment
histories, account balances and account activity, such
as deposits and withdrawals, parties to transactions
or loan advances;
- Information we receive from a consumer reporting
agency. Examples include your credit score, credit
reports and other information relating to your creditworthiness;
- Information we receive from employees and others
to verify information you have given to us. Examples
include verification of employment, income or deposits.

We do not disclose any nonpublic personal information about
our customers or former customers to anyone, except as permitted
by law and except as described in the next paragraph.
We may disclose all of the information we collect, as described
above, to: |
- Our affiliates, which are companies owned or controlled
by Downey Financial Corp., the parent company of Downey
Savings, including Downey Affiliated Insurance Agency,
which is in the business of insurance, and DSL Service
Company, a service company that is wholly owned by Downey
Savings and in the business of real estate investment;
- Third party service providers;
- Companies that perform marketing services on our
behalf; and
- Other financial institutions with whom we have marketing
agreements for the joint offer to you of financial
products and services, such as Downey Savings’ VISA® credit
card that is offered and issued through our joint marketing
agreement with FIA Card Services, N.A.

| YOUR PRIVACY CHOICES |
We will limit our sharing of your nonpublic personal information
according to the choices you indicate to us. For joint accounts,
the customer making the selection is opting out for all account
holders concerning that joint account. Please allow approximately
30 days from our receipt of your privacy choices for them to become
effective. Once you notify us of your privacy choices, they remain
in effect until you request a change. You do not need to notify
us each time you receive our Privacy Statement. |

| PROTECTING CUSTOMER INFORMATION |
Downey Savings maintains physical, electronic and procedural
safeguards that comply with federal regulations to guard your nonpublic
personal information. We restrict access to nonpublic personal
information to those employees who need to know that information.
We devote considerable resources to the maintenance of secure
Internet communications to help ensure that your transactions with
us are conducted in a safe environment. |
